1) Definitions

  • Services: QuadLab’s web application and related features.
  • Account: A registered user profile used to access the Services.
  • Organizer: An Account that creates or manages a campaign.
  • Participant: Any individual who submits inputs/feedback or ranks issues (anonymously, by invitation via email, or by providing name/email live).
  • Campaign: A structured activity collecting inputs/feedback on a problem statement; inputs are grouped by AI into nine issues/problems for ranking.
  • Content: Text or other materials submitted to a Campaign (including inputs, rankings, comments, titles, and descriptions).
  • Credits: Prepaid, non-cash units used for features such as invitations, AI runs, or other functionality we may offer.

2) Eligibility

You must be at least 18 years old and capable of forming a binding contract. You represent that any registration information you submit is accurate and complete, and you will keep it up to date.

3) Accounts & Security

  • You are responsible for all activities under your Account and must keep your credentials secure.
  • You must promptly notify us of any unauthorized use or security incident.
  • We may require email/OTP verification and may apply anti-abuse checks.
One Person, One Account. Creating multiple accounts to manipulate rankings, credits, access limits, or published insights is strictly prohibited and will be treated by QuadLab as fraudulent and illegal conduct. We may suspend or terminate all related Accounts, invalidate rankings or credits, recover losses, and, where permitted by law, refer suspected offences to authorities.

4) Acceptable Use

You agree that you will not, and will not allow others to:

  • Submit unlawful, defamatory, harassing, hateful, pornographic, or otherwise objectionable Content.
  • Submit or solicit sensitive personal data (e.g., health, religion, political opinions) through Campaigns.
  • Spam, phish, scrape, mine, or reverse engineer the Services, or bypass technical limits or rate caps.
  • Manipulate rankings (e.g., coordinated brigading, bots, sockpuppets, vote buying).
  • Infringe intellectual property or privacy rights, or violate applicable laws and regulations.

5) Campaigns & Submissions

  • Organizers must have the right to use the Campaign problem statement and any materials they upload, and must comply with applicable law (including obtaining any required consents when inviting Participants).
  • Participants may take part anonymously, by invitation via email, or by providing name/email live. You are responsible for the Content you submit.
  • License to QuadLab. You retain ownership of your Content. You grant QuadLab a non-exclusive, worldwide, royalty-free license to host, store, process, analyze, aggregate, and display the Content solely to operate and improve the Services and to publish de-identified, aggregated insights (e.g., Top 10 issues overall and by industry) on our landing page.
  • Moderation. We may remove or refuse Content that violates these Terms or applicable law.

6) AI Grouping & Rankings

  • The Services use AI to group Campaign inputs into nine (9) issues/problems and to support ranking workflows.
  • AI outputs are probabilistic, may contain errors or biases, and are intended to assist decision-making. They are not professional advice.
  • We may apply human review and other safeguards to maintain integrity and quality.

7) Outcome Quality & Best-Effort Basis

Best-Effort Only. The insights, rankings, and any published Top-10 lists (overall or by industry) are generated on a best-effort basis from participant inputs and algorithmic/AI processing. They are directional, informational outputs meant to facilitate discussion and prioritization—not definitive findings or guarantees of accuracy, completeness, or fitness for any purpose.

  • No Reliance for Critical Decisions. You remain solely responsible for independently verifying results and for any decisions or actions you take based on them.
  • No Performance Commitments. QuadLab does not warrant that outcomes will meet your expectations, produce business improvements, or achieve any particular result.
  • Context Sensitivity. Results may vary with participant mix, sample size, campaign configuration, time period, and data quality.

For clarity: The foregoing is in addition to, and not in lieu of, the Disclaimers and Limitation of Liability below.

8) Fees, Credits & Refunds

  • Some features may require the purchase or use of Credits. Credits are not legal tender, have no cash value, and are non-transferable unless we expressly permit otherwise.
  • Prices, packages, and billing arrangements may change from time to time; changes do not affect prior purchases already completed.
  • You authorize our payment processor to charge your selected payment method for purchases, taxes, and applicable fees.
No-Refund Policy (Important): All purchased Credits are non-refundable and not exchangeable, except where a technical error during payment processing results in: (a) a charge without corresponding Credits, or (b) a duplicate charge. In such cases, contact [email protected] within 30 days and include the transaction ID, amount, timestamp, and evidence. Upon verification, we will credit your Account or process a refund for the erroneous amount. We are not responsible for fees or exchange losses charged by your bank, card issuer, or payment provider.

Chargebacks. Filing an unfounded chargeback may be treated as abuse. We may suspend the Account and recover our costs to the fullest extent permitted by law.

9) Privacy & Data Use

  • QuadLab’s Privacy Statement explains how we collect, use, store, and disclose personal data, including options for anonymous participation, invited participation, or live name/email capture.
  • We do not sell personal data or share it with third parties for their independent marketing.
  • Publicly displayed insights are aggregated and de-identified (e.g., Top 10 issues overall and by industry on our landing page). Raw submissions and identities are not published without explicit consent.

10) Intellectual Property

  • The Services, including software, design, and documentation, are owned by QuadLab or its licensors and are protected by law. Except for the rights expressly granted here, no rights are transferred to you.
  • You may not copy, modify, create derivative works, or distribute the Services or any portion thereof except as expressly permitted.

11) Third-Party Services

We may use third-party hosting, analytics, email delivery, and payment processing providers. Such providers act on our instructions and are bound by appropriate agreements. Your use of third-party sites is at your own risk and subject to their terms.

12) Service Security

  • We implement safeguards appropriate to the nature of the data and risks involved.
  • You must not probe, scan, or test the vulnerability of the Services, nor breach security or authentication measures.

13) Disclaimers

No Warranties. The Services (including all AI features, insights, and published results) are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, QuadLab disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.
  • No Results Guarantee. We do not warrant that outputs will be correct, complete, unbiased, or suitable for your use case, or that they will produce business improvements or specific outcomes.
  • No Professional Advice. Outputs are informational and facilitative; you remain solely responsible for how you interpret or act on them.
  • No Uninterrupted Service. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components.

14) Limitation of Liability

To the maximum extent permitted by law, QuadLab and its directors, officers, employees, and suppliers will not be liable for any:

  • indirect, incidental, special, consequential, exemplary, or punitive damages; or
  • business-related losses, including loss of profits, revenues, anticipated savings, opportunity, goodwill, data (including corruption or loss of data), business interruption, or decisions made or actions taken in reliance on the results, insights, or rankings produced by the Services,

even if advised of the possibility of such damages and even if a remedy fails of its essential purpose.

15) Indemnity

You agree to defend, indemnify, and hold harmless QuadLab and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your Content or your use/misuse of the Services; (b) your breach of these Terms; (c) multi-account abuse, ranking manipulation, or fraud; or (d) your violation of any law or the rights of a third party.

16) Suspension & Termination

  • We may suspend or terminate your access immediately for breach of these Terms, suspected fraud, multi-account abuse, legal compliance, or risk to the Services or users.
  • Upon termination, licenses granted by you to QuadLab survive only to the extent necessary to operate the Services and maintain de-identified, aggregated insights already published.
  • You may close your Account at any time; outstanding fees remain due.

17) Governing Law & Disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the courts of Malaysia (e.g., Kuala Lumpur) to resolve any dispute arising from or relating to the Services or these Terms.

18) Changes to Terms

We may update these Terms from time to time. Material changes will be notified by updating the “Effective date” above and/or by in-product notice or email. Your continued use of the Services after changes take effect constitutes acceptance.
